PPWR FAQ 2026: 24 questions businesses are asking

Practical answers on regulatory scope, supply-chain responsibilities, packaging design, labelling, evidence and registration — with direct links to primary sources.

24 practical questions6 topic areasCurrent as of Oct 2026
Important: The PPWR generally applies from 12 August 2026, but not every obligation starts on that date. Later requirements and EU follow-up acts matter. The FAQ is for orientation, not individual legal advice.
01 / Scope and starting point

Who is affected?

The answers help classify typical business scenarios – not every detailed obligation has applied since 2026.

When did the PPWR generally start applying?

Regulation (EU) 2025/40 generally applies from 12 August 2026. Certain rules on labelling, design for recycling, recycled content and re-use have later start dates or depend on additional EU acts. Always check the applicable article.

Does the PPWR also cover transport and B2B packaging?

Yes. In principle, it covers sales, grouped and transport packaging and other defined packaging categories. Actual requirements depend on the type, use and market role. Certain labelling obligations exclude some transport packaging.

Are small businesses entirely exempt?

No. Specific exceptions exist, including limited rules concerning micro-enterprises and identification of the producer. Small size alone does not create a blanket exemption from the PPWR.

What matters when selling in several EU Member States?

EU product requirements are harmonised, but extended producer responsibility and registration are also implemented at Member State level. Businesses should review the relevant national EPR requirements in each market.

02 / Business roles and accountability

Who needs to act?

Conformity responsibilities and extended producer responsibility under the PPWR are not the same thing.

What is the difference between a producer and a manufacturer under the PPWR?

The producer in the PPWR product-conformity sense is generally the operator making or commissioning packaging or a packaged product under its name or trade mark. Manufacturer in the context of extended producer responsibility (EPR) may refer to a different market role. One company may fulfil several roles.

Who is responsible for retailers’ own-brand products?

Where a retailer commissions packaging or packed goods under its own name or brand, current EU explanations generally treat that retailer as the producer. A limited micro-enterprise exception exists. Contractual arrangements and the EPR manufacturer role must be checked separately.

What must an importer from outside the EU check?

Importers have to verify that the relevant conformity assessment and required documentation and information are available. They must be able to provide supporting records to authorities on a reasoned request. Their separate EPR role also needs assessing.

Do distributors have PPWR obligations?

Yes, depending on their position in the supply chain. Distributors must check relevant information and apparent compliance before making packaging available. Own brands, imports or first placing in a Member State may trigger additional responsibilities.

03 / Recycling, materials and shipping

When do technical rules change?

2026, 2030, 2035 and 2038 relate to distinct phases; certain dates can move if implementing rules come later.

Does packaging already need to be recyclable in 2026?

Article 6(1) requires recyclability in principle from 12 August 2026. Harmonised design-for-recycling criteria take effect from 1 January 2030 or 24 months after the relevant delegated acts enter into force, whichever date is later.

What do recyclability grades A, B and C mean?

Annex II provides for grades A, B and C. From the applicable date, no earlier than 2030, packaging will generally need a grade of A, B or C to be placed on the market; from 2038 the rule generally narrows to A or B. The assessment depends on the detailed criteria and exemptions.

Must all plastic packaging contain one fixed recycled-content percentage in 2030?

No. Article 7 provides different minimum shares for defined plastic packaging types and includes exemptions. The relevant date is no earlier than 1 January 2030 or three years after the relevant implementing act, if that is later.

Is the 50% empty-space limit for e-commerce already in force?

No. This specific PPWR limit for defined grouped, transport and e-commerce packaging generally applies from 1 January 2030 or three years after the implementing act setting its calculation methodology, whichever date is later. Packaging protection and other special circumstances are relevant.

04 / Labelling and special packaging

What belongs on a label?

Material pictograms, QR codes and reuse information depend on packaging category and effective date.

Has new sorting pictogram labelling been compulsory since August 2026?

No. Harmonised material-composition labelling under Article 12 applies from 12 August 2028 or 24 months after the relevant implementing acts enter into force, whichever is later. Exemptions include certain transport and deposit-return packaging.

Will every packaging item require a QR code?

No. A QR code or other standardised open digital data carrier is particularly relevant for certain reusable packaging. Other digital obligations may apply in specific cases, but there is no universal QR-code requirement for all packaging.

When will reusable packaging need new labelling?

Article 12(2) provides for the labelling of reusable packaging from 12 February 2029 or 30 months after the relevant implementing act takes effect, whichever is later. Certain open-loop systems are exempt.

What PFAS requirements apply to food-contact packaging in 2026?

Article 5(5) sets limits for PFAS in food-contact packaging from 12 August 2026. Businesses must consider the relevant thresholds, analytical methods and separate food-contact laws. General claims without reliable testing are inadequate.

05 / Documentation and conformity

What evidence is needed?

Technical records must match the specific packaging and the requirements actually applicable.

What belongs in a PPWR technical file?

Annex VII covers the packaging description, relevant design and materials information, applicable requirements, assessment documents and, where appropriate, test reports. Its exact scope depends on packaging type and the provisions in force.

Does every packaging type need third-party certification?

The PPWR does not generally mandate external certification of every packaging type. Annex VII describes internal production control. Independent test reports may help or be necessary in individual cases, while the producer retains responsibility.

Is an EU declaration of conformity the same as a test report?

No. The EU declaration under Article 39 and Annex VIII is a formal declaration by the responsible producer. Test reports, specifications and assessments can form part of the supporting technical documentation.

How long must conformity records be retained?

The PPWR generally requires the technical file and declaration to be kept for five years for single-use packaging and ten years for reusable packaging after placement on the market. Other record-keeping rules may also apply.

06 / German registration and communication

How do companies apply the rules?

Identify the correct role, preserve good evidence and distinguish marketing claims from legal compliance.

Should businesses review their LUCID registration in 2026?

Yes. Germany’s Central Agency Packaging Register explains that the PPWR changed responsibilities from 12 August 2026. Businesses should check their EPR manufacturer status and update registration details promptly when necessary.

Does LUCID registration alone meet system participation obligations?

No. Registration, system participation and packaging-volume reports are separate obligations. Companies must determine whether packaging falls under system participation and which operator is responsible.

Can businesses advertise “PPWR compliant” or “100% recyclable”?

Environmental claims must be accurate, specific and supported by evidence. PPWR conformity does not automatically substantiate every green marketing statement; rules against misleading sustainability advertising also apply. Broad advertising promises deserve careful review.

Where can businesses check new PPWR guidance and dates?

Use EUR-Lex for the binding text, European Commission guidance and FAQs for interpretation, and the Central Agency Packaging Register for German EPR questions. Recheck developments before finalising internal deadlines.
